Terms of Use

GOGIA IS NOT A MEDICAL DEVICE AND DOES NOT DIAGNOSE, TREAT OR CURE ANY CONDITION.

These Terms of Use govern your use of the GOGIA application (“we”, “us”, “our” or the “app”), which provides AI-based interactive light and sound sessions to support focus, relaxation and mental wellbeing to users (“you” or “your”).

1. General

  1. The service is intended exclusively for individuals at least 18 years old or older.
  2. GOGIA is not a medical device and does not diagnose, treat, or cure any condition. It is a wellness tool designed to support focus, relaxation, and mental wellbeing. Always consult a licensed professional for medical concerns and in case of acute psychological issues or crises seek professional help.
  3. This application contains flashing lights that may trigger seizures in individuals with photosensitive epilepsy or other sensitivities. Users with light sensitivity are excluded from using the service.

2. Scope

  1. These terms and conditions apply to all contracts concluded between us and users regarding the use of service
  2. The contract for the user of the service is established upon user registration.
  3. GOGIA provides short daily interactive light and sound sessions through a standalone application, titled GOGIA. These services may be free or paid and are governed by the respective service description on our website or within the application.
  4. We reserve the right to modify, expand or discontinue the offering at any time.

3. Account Responsibility

  1. Registration is required to use the service. Users must provide truthful personal information and keep it up to date.
  2. Users must confirm that they are at least 18 years old and that none of the exclusion criteria listed in (3) apply.
  3. Users are responsible for keeping your login details confidential. Users agree not to impersonate another person or misrepresent their identity. Users agree to notify us immediately in the event of misuse.

4. Right of Withdrawal

  1. Users have the right to withdraw from the contract within 14 days of conclusion without providing a reason. Withdrawal must be made by email to the contact address provided on the website

5. Liability

  1. We are not liable for decisions or actions taken by users based on the use of the service. We expressly do not guarantee specific outcomes or results.
  2. We are not liable for any mental or physical discomfort you may experience while using the app. Use as is at your own discretion and risk.

6. Data Protection

  1. We treat all user data confidentially and process it exclusively in accordance with the applicable data protection regulations (GDPR).
  2. Further details on data processing are provided in our privacy policy.

7. Intellectual Property

  1. All content, including visuals, sound and interactive elements, are either:
  • Created in-house and owned by us, or
  • Used under license from Envato Elements or other royalty-free sources.
  1. You may not copy, modify, or distribute any content from the app. Any use beyond the expressly granted rights requires our written consent.

8. Usage Restrictions

  1. You agree not to:
  • Use the GOGIA application in violation of any laws.
  • Attempt to reverse-engineer or disrupt the GOGIA application.

9. Changes to Terms

  1. We reserve the right to amend or expand these Terms at any time with future effect.
  2. Users have the right to object to changes within six weeks. If no objection is made, continued use after changes means you accept the updated Terms.

10. Final Provisions

  1. If individual provisions of these Terms and Conditions are invalid, the remaining provisions shall remain unaffected.
